As far as I know, it's not illegal as long as all of the original emissions control devices remain intact.. but that is here in Missouri.

There in California... they have all kinds of weird quirky laws...

Pretty much any modification that is visible is illegal in CA unless you have a sticker for it. Since the 2.0 TB is a unmodified, stock, Ford part you should be able to get away with it. You might want to peal off the sticker that has the production date on it off the newer TB so they won't get suspicious. As for the porting they will never see that so don't worry about it.

You would still get the Weapon R intake for the 1.9 but I don't think it will pass emissions with it. CA is really big on outlawing aftermarket air intakes unless the manufacture provides a CARB exempt sticker. The stock intake will fit the 2.0 TB.

as long as it is nothing blatant, you will be ok. Cali regulations are a LOT more strict than most other states.

Post back if you experience any issues. (to warn others)

The computer should compensate for any additional air with additional fuel, thereby keeping emissions in check. However, as a general rule, more air equals more exhaust. More exhaust will leave you less overhead for passing e-Check if the car isn't running perfectly.

i was told with upgrading the intake duct, ur not gonna see any power gains with the stock exhaust system. i changed mine and noticed nothing cuz i still have the stock exhaust on my car. i don't even expect to see any power gains when i put on the spi throttle body but i could be wrong. and the reason why i asked what year ur car was to see if u had the smaller MAF like i once had. that thing was a restriction.

You don't need to upgrade your exhaust to see a gain from an air intake. The bottom line is the stock 1.9 air duct is bigger than the bore of almost any throttle body you can put on the 1.9 and is smooth inside. Going bigger than smallest point of the TB is worthless and will actually hurt performance. Upgrading it is more of an aesthetic and "way it sounds" thing on the 1.9. The stock airbox on the other hand is ridiculously restrictive. That can be easily modified or a cone filter put on in place of it. Upgrading the exhaust however is a good thing to do when you upgrade your throttle body. The stock system is overly restrictive and can hamper the gains you will get from the bigger throttle body. Just stepping up to 2" pipe with a performance muffler is the best way to go unless you plan on going turbo or using an aftermarket header. You may still see some power gains from the 2.0 throttle body as the later Escorts that engine came on had the same sized exhaust as yours.
